Acceptance of Terms

By accessing this website, placing an order, making a payment, or engaging Sweet Madness Cake Designs (“SMCD”, “we”, “us”, “our”), you agree to be bound by these Terms and Conditions.

SMCD reserves the right to amend these Terms at any time. Any updates take effect immediately upon publication. Continued use of our website or services constitutes acceptance of the updated Terms.

We reserve the right to refuse service or cancel an order at our discretion.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Due to the perishable and custom-made nature of our products, repairs are not applicable. Where a failure does not amount to a major failure, remedies will be provided in accordance with Australian Consumer Law.

Nothing in these Terms and Conditions limits your rights under Australian Consumer Law.

All products are made to order and subject to availability.

Customers are responsible for checking availability before placing an order. Online shop items require a minimum of 72 hours’ notice unless otherwise stated.

Shop orders will be prepared for the date selected at checkout or, if unavailable, the next available business day.

Prices are reviewed periodically and may change due to increases in ingredient costs, materials, labour, and operational expenses.

Pricing reflects the time, skill, design complexity, and resources required for each order. Final pricing is confirmed on the issued invoice.

Quotes are valid for 7 days from the date issued.

A minimum 50% payment is required to secure a booking for a certain date. Orders are not confirmed until payment is received and confirmed by SMCD.

The remaining balance is due 14 days prior to delivery or collection. Orders placed within 14 days require full payment upfront.

Short-notice or urgent orders are accepted at the discretion and availability of SMCD and may incur a rush fee.

Late or unpaid invoices may result in automatic cancellation.

No work will commence until payment has cleared.

Once confirmed, you will receive an invoice detailing all order information, including:

Design

Flavours

Names and spelling

Dates and times

Delivery or collection details

 

It is the customer’s responsibility to review the invoice carefully.

Failure to notify SMCD of any errors before production begins releases SMCD from responsibility for those errors. No refunds, credits, or replacements will be issued for customer-approved details. Full or part payment of an invoice is considered an acceptance of the content of said invoice.

All changes must be submitted in writing.

Changes requested within 14 days of delivery or collection may incur a surcharge and are subject to availability of time, materials, and ingredients.

SMCD reserves the right to substitute unavailable materials with suitable alternatives where necessary.

Deposits are payments to secure booking time, preparation, and planning and are generally non-refundable, except where required under Australian Consumer Law.

Cancellations within 14 days of delivery or collection are not eligible for refunds or credits.

At the discretion of SMCD, payments may be converted to a credit note. Credit notes:

Are valid for 12 months from the original booking date

Are subject to availability

Are non-transferable and non-extendable

Expire automatically if unused

A second cancellation voids any credit issued.

Pick-up is by appointment only. The collection address will be provided once payment is complete.

Orders must be collected within the agreed timeframe. Orders not collected within 24 hours will be disposed of and no refund will be issued.

Delivery occurs within designated delivery windows.

Someone must be present to accept delivery. Cakes cannot be left unattended. Anyone accepting delivery is deemed authorised by the customer.

If delivery cannot be completed due to:

Incorrect address details

Restricted access

No authorised recipient present

The order may be returned to SMCD for collection within 24 hours or a re-delivery fee may apply. Availability for re-delivery is not guaranteed.

Uncollected cakes will be disposed of with no refund.

Cakes are delicate and perishable.

Responsibility transfers to the customer upon delivery or collection. SMCD is not responsible for damage caused by:

Transport

Heat exposure

Improper handling

Storage after delivery or collection

Customers are advised to transport cakes on a flat, level, non-slip surface in a cool environment.

All cakes are handcrafted and unique.

Reference images are used for style inspiration only. Exact replication cannot be guaranteed.

Minor variations in colour, finish, texture, size, or design are normal and do not constitute a fault.

All products are made in a kitchen that handles nuts, gluten, and dairy.

While reasonable care is taken, allergen-free products cannot be guaranteed.

SMCD is not liable for delays or cancellations caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, government restrictions, mechanical failure, or traffic incidents.

Where performance becomes impossible, remedies will be provided in accordance with Australian Consumer Law.

If you experience an issue with your order, please contact SMCD as soon as possible. Freeze your cake immediately and return it to us within 24 hours.

Refunds, replacements, or credits are assessed on a case-by-case basis and provided in accordance with Australian Consumer Law.

These Terms and Conditions are governed by the laws of Victoria and the Commonwealth of Australia.

By placing an order or making payment, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full.
